Applicable to the scope and needs of your company, Bellwether can advise on, prepare, or update service- and employment-related agreements, address broader issues and documentation required from a compliance/policy perspective, and handle any disputes or potential  mediation and/or arbitration. 

For start-ups in particular, knowing their overriding imperative to address issues as they arise, this can mean tailored sets of materials addressing both immediate issues, with potential add-ons kept on hand—such services for these companies is typically appropriate at flat rates, which also ensures that cost concerns don't result in noncompliance.  

With respect to developing and drafting agreements that form a company’s client service relationships, these include:

  • employment and severance agreements;

  • executive employment and severance agreements; 

  • independent contractor arrangements; and as necessary,

  • additional clauses or addenda appropriately addressing proprietary information and assignment of inventions agreements, noncompetition agreements, non-disclosure agreements, among other things.

This can include guidelines and checklists, memoranda, or issue-specific counsel advising on effective compliance with the various federal, state and local employment laws that govern the employment relationship (which federally, include: FLSA, Title VII, ADEA, ADA, FMLA, WARN, OSHA, NLRA and FCRA).

Bellwether is also available to assist with any disputes or claims that might arise from employees, and handle or assist in any pre-litigation discussions or internal investigations—in such cases, this will be done with an eye to preventing future issues, and will address as requested, the policies and agreements for necessary updates.

And related to the general agreements are the equity incentive plans and agreements going to the various equity awards under such plans (e.g., stock options, restricted stock, restricted stock units, performance awards)—all of which can include customized alternatives to fit a company’s stage of development.

​Toward the preemptive efforts in connection with compliance evaluation, Bellwether can help companies develop their sets of internal policies, employee handbooks, and either related or recommended plans, processes and procedures to help reduce the risk of future legal claims.
